Honor Society!

The National Academy of Financial Literacy (NAFL) is pleased to announce ourselves as the first Licensed Business College in the United States to be accepted into The National Society of Leadership and Success Program. What is significant about this new relationship is that prior to our approval, this program was only available to Universities and State Colleges, where the program has been instrumental in leading thousands of students across the country into a successful future.

Beaverton, Oregon February 15, 2010 -  This program, previously available exclusively to the traditional higher learning community, is now being introduced into the business community to help our country rebound from so many financial failures, at a grass roots level. The program includes Monthly Broadcasts bringing Nationally renowned speakers to the Student and Business Community on a monthly basis.  Other benefits include Success Networking, scholarships, help with Resume Writing, Personal References to Employers, Leadership Education, and Leadership Certification along with other opportunities for personal growth and success.

How does this work?

While our chapter is in charter, we will take advantage of webinar tools to meet, and discuss our goals as a group; as we grow, we will be establishing sub-chapters nationwide where you will be able to meet with pending members,  full-fledged members, and our alumni at a location nearest you.

Becoming a certified member of the National Society of Leadership and Success is easy! In order to become inducted as a Certified Leader you must:

  • Attend one Orientation
  • Attend three Success Networking Team meetings
  • Attend three Speakers Series presentations
  • Attend one Leadership Training Day event

Additionally, there is an opportunity to receive the coveted National Excellence in Leadership Award by also:

  • Attend three additional Success Networking Team meetings
  • Attend three additional Speaker Series presentations
  • Complete five hours of community service. NAFL will provide ongoing opportunities for you to participate in or you can pick your own.

NMLS Approved!

NMLS-Approved-Provider-LargeThe National Academy of Financial Literacy is proud to announce our School Approval with the Nationwide Mortgage Licensing System.  Our  NMLS Provider number 1400116, grants us School approval to offer NMLS Certified Classes.

On May 04, 2010 our PE Comprehensive 20 hour class was  approved  as Course Number 1540.   President Linda MacCoy is quoted as saying “this has been a very long and intensive process.”  We are pleased that NMLS has raised the bar so high, insuring quality education delivery. The class is approved for Live Classroom Delivery.

This 20 hour Comprehensive class meets your Pre-License mandatory class requirements.  We are also offering a one day Intensive Cram Class that prepares our students for the mandatory national exam.

Other classes are planned, so watch for additional class offerings into the coming months.

Linda stated that “ she has been instructing similar classes for over 5 years, with student passing at much higher scores than the National Average, which is 71%.”  A passing score is 75% or higher.

Legal Matters - Foreclosures

Historically, in Oregon, a lender could not claim a deficiency judgment on a foreclosure of a primary residence, whether the foreclosure was done judicially or non-judicially.  However, a homeowner with both a first and second Trust Deed could end up with a judgment against him or her following foreclosure of the first Trust Deed.  A foreclosure of the First Trust Deed would wipe out the lien of the second Trust Deed but would not wipe out the debt of the second Trust Deed.  Consequently, assuming that Chase had a first Trust Deed and Bank of America had a second Trust Deed, a foreclosure by Chase would destroy Bank of America's security interest but not the debt, and Bank of America would typically proceed to collect the balance on the Note which had formerly been secured by the second Deed of Trust.

In 2008, the Oregon legislature passed a bill which had the effect of satisfying the debt on the second Trust Deed if the first Trust Deed were foreclosed and both loans were made on the same day by the same bank and were owned by the same bank at the time of foreclosure.  The obvious loop hole for the bank would be to sell off the debt secured by the second Trust Deed and the related security agreement prior to foreclosing on the first.  In the special session held in 2009, the Oregon legislature passed House Bill 3004 which prevents the foreclosing lender from asserting a deficiency or collecting from the borrower for either loan if both loans were made on the same day by the same bank. Under the new law, it doesn't matter who owns the loans on the date of the foreclosure. The lender's remedy is limited to the proceeds of the foreclosure sale or recovery of the property. This is true whether the loans were for the original purchase of the property or for a re-finance.

A party who borrows on a first Trust Deed from a particular bank on a given date and later obtains a HELOC from that bank will not be protected on both loans merely because one is foreclosed.  That is because the loans were not taken out on the same date.  However, a HELOC secured by a Trust Deed which is recorded on the same day as the first Trust Deed is recorded will have the same protection as a typical 80-20 from the same bank on the same day.

The new House Bill is retroactive.  That is, it doesn't matter when the loans were made as long as they are foreclosed after the effective date of the new law which occurred in March of this year.  The jury is still out on whether some lender will challenge the retroactive effect of the law.

Please note that the new law does not address the potentially negative tax consequences of having one's residence foreclosed and the debt forgiven.  However, limited relief is afforded under the Mortgage Forgiveness Debt Relief Act of 2007.
